War or negotiation? This fundamental question was the starting point for writing this book. The United States’ withdrawal from the JCPOA, the intensification of unilateral sanctions, and the recent military attacks against Iran compelled me to examine, from the perspective of international law, whether legal mechanisms can effectively safeguard national interests. In this book, I take a thorough and well-documented look at Iran’s historical engagement with the International Court of Justice—from the nationalization of the oil industry and the resulting dispute with Britain, to today’s critical cases involving the 1955 Treaty of Amity, unilateral sanctions, the JCPOA and Iran’s nuclear program, military aggression against the country, the seizure of Iranian assets, the downing of Ukraine’s flight PS752, and the violation of Iran’s state immunity by Canada. This work aims to demonstrate that, when employed wisely and professionally, legal diplomacy can serve as a powerful and effective alternative to military confrontation.
